1. Acceptance of Terms
By accessing or using BidSparq ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by BidSparq ("we", "us", "our").
2. Description of Service
BidSparq is an RFP matching and alert platform that scans procurement portals and delivers matched bid opportunities to subscribers via email and a web dashboard. We aggregate publicly available procurement data from government, education, and commercial sources.
3. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.
4. Free Trial & Subscriptions
New accounts receive a 14-day free trial. After the trial, continued access to paid features requires an active subscription. Subscription fees are billed monthly in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period.
5. Refunds
If you are not satisfied with the Service, contact us within 30 days of your first payment for a full refund. Subsequent months are non-refundable but you may cancel at any time to prevent future charges.
6. Data Accuracy
We aggregate data from third-party procurement portals and make reasonable efforts to ensure accuracy. However, we do not guarantee that all RFP listings are complete, current, or error-free. Always verify bid details and deadlines on the original source portal before submitting a proposal.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Resell, redistribute, or commercially exploit the data provided by the Service without written permission
- Attempt to reverse-engineer, scrape, or programmatically access the Service outside of the provided interfaces
- Interfere with or disrupt the Service or its infrastructure
8. Intellectual Property
The Service, its design, and underlying technology are owned by BidSparq. Procurement data aggregated from public sources remains public domain. Your company profile data and preferences remain yours.
9. Limitation of Liability
To the maximum extent permitted by law, BidSparq shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including missed bid opportunities, lost revenue, or data inaccuracies. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your access to the Service will cease and your data will be deleted within 30 days.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance.
